Mistakes after a traffic accident may hurt your case. Knowing what to do can save you a lot of precious time and resources as you seek to build a strong case. Our truck accident lawyers in Texas handle these cases daily and are aware of the most common mistakes many victims make inadvertently.
It is important to let a truck accident lawyer in Bellaire handle your case from the beginning to the end, saving you a lot of stress and anxiety over what to do and what to expect. Some of the most common mistakes to avoid in a truck accident in Bellaire are:
Not Reporting Your Accident
Besides being a legal requirement, especially in Texas, reporting a crash to the local police department helps to make the crash a public record. Failure to do so can create complications that may affect a future claim.
When you call 911 and report an accident, a team is sent to the scene. It not only helps with coordinating the medical response to injured victims but also secures the scene and investigates the happenings leading to the crash. The final police report may be admissible as evidence when building your injury case.
Not Remaining at the Scene
The aftermath of a devastating crash can be overwhelming, and it’s not a surprise that some victims get lost in the process and forget their legal duties.
One of them is stopping and remaining at the scene. Even if you feel traumatized or anxious, leaving too soon may hurt your case. Unless it is on medical grounds, fleeing an accident scene may amount to a felony.
Always try to remain calm and gather your thoughts to avoid making irrational decisions that may come back to bite you in the future, especially when filing a lawsuit is in the picture.
Failing to Seek Medical Attention
Another common mistake to avoid in a truck accident in Bellaire is failing to seek medical attention. Although many crashes result in evident bodily harm such as broken bones, spinal injuries, cuts, bruises, amputations, or head injuries, some cause silent killers such as traumatic brain injuries, internal bleeding, and organ damage.
In this scenario, the victim may believe he or she was not injured, only for the injuries to show days later. Again, you will need medical documentation to prove your injury claim, and the only way to do so is by seeing a doctor immediately after an accident.

Not Gathering Evidence
Another mistake to avoid after a truck accident in Bellaire is failing to gather evidence from the scene. Remaining behind to collect all information related to the crash and documenting the scene is a crucial step in safeguarding the facts about the accident before they are distorted or tampered with.
In any case, you cannot trust the other party to be forthcoming, so it is necessary to take photos of the scene, your injuries, as well as the parties and vehicles involved.

Not Exchanging Information
Always collect as much information as you can from all the parties present at the scene. Talk to as many eyewitnesses as possible and record their statements.
Their side of the story matters when proving your claim, so you must have them on record before the scene is cleared. Remember to also record their contact information for easier tracing in case they are needed to testify. The other party’s insurance and contact information are also essential.
Failing to Notify Insurance Companies
If insured, you must report the accident to your insurance company as soon as possible. Different companies provide different mechanisms for reporting the occurrence of an insured risk.
For example, they must be notified within a limited timeframe as specified in the terms of their insurance policies. Usually, you have 24-48 hours to report your accident, but the sooner you do it, the better.
Also, remember not to say too much more than you should, since you can’t trust insurance companies and adjusters to treat you fairly.
