How Compensation for a Car Accident Claim Works
Normally, any personal injury claim process begins with the injured party retaining an attorney. While you can file your case by yourself, hiring a personal injury lawyer increases your prospects of having a fair settlement. In any case, you must be prepared for the resourceful attorneys that represent these multi-billion dollar insurance companies. Your case begins the moment you step into our offices. And through the free case evaluation sessions we offer, our lawyers get to review and understand your case better.
If your case is viable, your assigned legal team embarks on a fact-finding mission to establish liability and determine whether negligence played a role in the accident. It’s through these investigations that a personal injury case is made. After establishing fault, your attorney may write a demand letter to the liable party’s insurance company indicating what the case entails, and the damages you seek compensation for. An insurance adjuster may have reached out already with an initial offer, allowing both parties to deliberate on the best and fair settlement for your damages. If a mutual understanding is reached, you are settled and that marks the end of the legal process.
But if case negotiations fail to yield the intended results, which happens in many high-value cases, your attorney proceeds to court. Here, a judge or jury will decide your fate based on the evidence tabled before the corridors of justice. This is basically where your attorney’s experience, aggressiveness and expertise are put to test. A good car accident lawyer understands how different personal injury laws apply in a car accident claim and will do everything possible to make a strong indisputable case. If the judge or jury is convinced you deserve compensation, the defendant, often through his or her insurance company, will be compelled to compensate you.
How Does Comparative Negligence Affect My Financial Recovery?
It’s not unusual to come across car accident victims who contributed to their own injuries. This can happen anywhere, but as long as your degree of fault falls below 50%, you can still recover compensation. Any form of negligence from the other party may be responsible for the car accident, and therefore, retaining a knowledgeable lawyer for a legal evaluation should be your top priority after seeking medical attention.
Precisely, your final compensation will depend on your degree of liability. If you are 40% to blame for your own injuries, a similar percentage will be deducted from the total compensation awarded. For example, in your damages are valued at $40,000, you will only receive $24,000 as your final payout.
What Damages Am I Entitled to in a Car Accident Claim?
Depending on your case, you may be entitled to an array of damages. This will also be based on your attorney’s ability to prove them. They include:
- Lost wages
- Wrongful death
- Loss of income earning capacity
- Loss of quality of life
- Permanent disfigurement
- Lost financial benefits
- Past and future medical costs
- Pain and suffering
- Emotional trauma
You may also qualify for punitive damages depending on the facts of your case. Be sure to discuss this with your attorney during case evaluation.
