According to the Motorcycle Industry Council, motorcyclists make up 8% of all drivers in the United States. Yet, statistics indicate that they are more likely to suffer fatal harm in an accident compared to vehicular crashes. Whether you were a pedestrian, passenger, or rider in a motorcycle accident, it is important to know the right steps to take after a collision.
We usually come across victims who regret not knowing what to do after a motorcycle accident in Cypress. Unfortunately, some make mistakes that ultimately hurt their chances of collecting damages for their injuries and losses. However, with the following list of recommendations our skilled motorcycle accident attorneys put together, you should have your rights protected in case you are involved in a similar crash:
Immediately Following a Motorcycle Wreck
If you are injured in a motorcycle accident in Cypress, the first step you should take is to report to the nearest police department. Although not all accidents require you to notify local police, you should always file a report if your injuries are severe or require medical treatment. Give your side of the story and retain a copy of the police report before leaving the scene. This document is crucial in any injury case as it paints a clear picture of what may have transpired and the parties likely to be at fault. Most importantly, the police report acts as proof that you were in an accident.
Remain at the Scene
It is crucial to remain at the accident scene until the police arrive. Leaving may give the impression that you were at fault, which is not something you want, especially if you wish to pursue compensation. As long as you are not severely injured, it would be best if you stayed at the scene.
Seek Medical Evaluation
Because many motorcycle accidents are catastrophic, it is vital that you seek immediate medical evaluation after a crash. Some injuries may not be evident immediately and may take days or weeks to show. If left untreated, some of them can be fatal. Document all injuries you suffered and their symptoms and discuss them with your physician. If placed on treatment or medication, please ensure that you follow up with your doctor’s plan. Failing to do so can be detrimental to your case.
Other Steps to Take After a Motorcycle Accident
After being involved in a motorcycle accident in Cypress, filing an injury claim may be the last thing on your mind. This means you may have to focus on treatment first before pursuing compensation through a court process or negotiating with insurance companies. With everything that is going on around you, it is likely that you may not have enough time to file a claim. Texas statute of limitations only allows a maximum of two years for an injury claim to be brought forward. Therefore, it is imperative that you notify your insurance company about your accident as soon as possible, either immediately or a few days later.
Talk to Witnesses and Document the Scene
If you can, remain at the scene and collect crucial evidence. Using your cell phone or any other recording device, take photos of the scene capturing your injuries, property damages, vehicles involved, as well as testimonials from eyewitnesses. Note down their contact information detailing their names, addresses, and phone numbers for future purposes. They may turn out to be invaluable assets when pursuing compensation.
Contact an Attorney
To ensure that your legal rights are protected, it is vital after a Cypress motorcycle accident to contact an attorney as soon as you can. If possible, call them immediately after the accident. This way, they have ample time to visit the scene to gather evidence before it’s cleared. Always do background checks on an attorney before hiring them to look into your case and fight for your rights. At the very least, the best attorney has a proven track record with great testimonials from past clients and is accredited and qualified to practice personal injury law.
