An auto wreck can drastically change how victims live. Recovering from the physical and financial challenges that usually follow is, without a doubt, not an easy process.
If you are not as careful and steadfast about your legal rights, you may end up carrying the financial burden alone. Texas laws guarantee car accident victims compensation as long as they can prove that another party or entity was to blame for the injuries and losses suffered.
While you may be aware of your rights as far as compensation is concerned, only a few people understand what the settlement process involves and the damages available.

Qualifying for Compensation
Being injured in an auto wreck does not automatically make you eligible for La Marque car accident compensation. Before you file your claim with insurance companies or proceed to court, you must establish the basis of your case.
In Texas, car accident cases are determined based on negligence. Simply put, you must bring forth evidence showing that another party failed to observe standard and reasonable care when they ought to have done so.
Essentially, you must prove that:
- A duty of care existed
- The duty of care was breached
- The breach caused your injuries or losses
- You suffered damages
Proving causation and breach of duty is perhaps the most difficult part of negligence. Without linking your injuries or crash to the specific actions or inactions of another party, you are likely not to qualify for compensation.
Hiring a skilled La Marque car accident attorney to do the legwork on your behalf saves you a lot of time, resources and energy that you should otherwise direct to your recovery.
After all, you lack the experience, skills, and resources to effectively investigate critical aspects of your auto wreck.
Car Accident Compensation Through Insurance Companies
Once you have established the parties or persons to hold accountable for your injuries and losses, the next step in the La Marque car accident compensation process is filing a claim with insurance companies.
If another motorist was at fault, you file a claim with their insurance company, employer, or vehicle owner. Since all drivers must carry valid insurance, the duty to reimburse auto wreck victims then shifts to the insurance companies and not the individual at-fault parties.
In case the other party is not insured, you may bring your case to your insurer with the help of an experienced car accident attorney.
Insurance adjusters act as representatives of insurance companies and are therefore tasked to settle your claim through negotiations. However, you should not mistake them for your friends, no matter how concerned or friendly they look. Their goal is to safeguard and protect the interests of insurance companies even at your expense.
If you’re not careful, you may end up accepting lowball offers or none. That’s all the more reason you ought to work with an aggressive La Marque car accident attorney.
Filing a Lawsuit
Car accident compensation in La Marque car accident cases is usually achieved through negotiations with insurance companies. However, some cases proceed to court.
As the plaintiff, you have the right to decide how to settle your case. You may decide to deal with insurance companies first, or directly file a lawsuit in court without involving adjusters. However, the court system is more complex and time-consuming.
A qualified attorney will help you draft a demand letter or petition, noting the details of your accident, injuries suffered, and your demands.
The at-fault party or defendant, as will henceforth be referred to, will have a limited time to answer your allegations by accepting or denying your claim. This will officially mark the beginning of the car accident compensation process.
Your attorney will represent you in ensuing trial phases such as written discovery, oral discovery, depositions, mediation, and trial.
